On the legalization of policies for the industrial distribution in the free trade port with Chinese characteristics
The construction of free trade port with Chinese characteristics highlights the government will,and its industrial distribution should be analyzed from a three-dimensional perspective of the law of economics,the tool of policy,and the legal guarantee.Further observation should be made on the basis of dual structure that consists of the general distribution of nation-wide free trade ports under the view of the central govern-ment and the redistribution of industrial parks under the view of the free trade port.On this basis,the foreign experience can be used for reference to explore the legalization path to the policies for the industrial distribution of free trade port with Chinese characteristics.At present,there exist the problems,such as the lack of unified legislation at the national level,and the lower-scale documents at the local level.It is suggested that National People's Congress or its Standing Committee formulates Law of the Industrial Distribution of Free Trade Port to introduce into the legal track the game of the establishment and operation of free trade ports between the central and the local.Further,Hainan Provincial People's Congress or its Standing Committee formulates the Regulations on the Administration of the Industrial Parks in Hainan Free Trade Port,setting up such specific rules as the establishment,adjustment,and investigation into liability for the industrial parks of free trade port.
