Possibilities and realities:a study of cyber sexual assault in the context of metaverse technology
The explosive development of metaverse-related technologies,especially brain-computer interface technologies,has made various kinds of cyberspace sexual assaults,especially the cyber sexual intercourse,a realistic possibility.The main elements of cyber sexual assault are the tools of the act("online social platform"and"remote erotic device+online platform"),the degree of sexual contact(the fifth level)and the type of act(five categories).The current criminal law regulates the sexual assault over the Internet only by the crime of indecent assault,and cannot apply to the crime of rape or sexual assault by a person with caregiving duties.With reference to the regulation system of sexual assault under the current criminal law,this paper proposes to delineate the boundary between sexual intercourse and indecent acts according to the viewpoint of"sexual penetration-penetrated center".Further it is suggested to expand the scope of the crime of rape and the crime of sexual assault by a caregiver,and change the crime of rape to the crime of forced intercourse.The construction of a new criminal law system for sexual assault crimes can respond to the emergence of various complex cyber sexual assaults under the metaverse technology,which can be utilized as an opportunity to promote the construction of international standards for sexual assault crimes.
