Reflections on Effective Legal Assistance in Cases of Pleading Guilty and Admitting Punishment
The effective legal assistance of the accused is the legitimate basis of the leniency system of guilty plea.From the top-level design analysis,the legislation has always paid great attention to the protection of the rights and interests of the accused,providing a normative basis for the realization of effective legal help in the case of guilty plea.From the per-spective of judicial practice,through the analysis of 116 criminal judgments of first instance in C City during 2023,it finds that effective lawyer help has not been truly realized in practice,and it needs to be corrected through disciplinary mecha-nisms,judicial remedies and other means.
