论"双碳"目标下碳市场监管和解合规制度

摘要
对碳市场的行政监管有利于营造良好的市场氛围,推动碳达峰、碳中和目标的实现.但碳市场在传统高权行政监管模式下存在立法层面激励机制的缺失、执法成本过高、过程性监管措施缺位等实践困境,亟需做出调适.企业行政合规治理在我国的探索发展为我国碳市场监管提供了一种理想且可行的路径,对碳市场的监管思路应当由高权行政转向行政和解合规.在导入和解合规理念的基础上,碳市场和解合规应遵循依法行政、公益优先、诚实守信、可持续发展原则.碳市场和解合规制度的体系建构,应围绕标准制定、合规计划的实施与监督三个方面具体展开,进而推动碳市场和解合规实践发展.
Abstract
Administrative supervision of the carbon market is conducive to creating a good market atmosphere and promoting the achievement of the carbon peaking and carbon neutrality goals.However,the carbon market faces practical difficulties such as the lack of legislative incentive mechanisms,high enforcement costs,and a lack of procedural regulatory measures under the tradi-tional high authority administrative supervision model,which urgently require adjustment.The ex-ploration and development of corporate administrative compliance governance in China provides an ideal and feasible path for carbon market regulation,and the regulatory approach to the carbon mar-ket should shift from high authority administration to administrative reconciliation and compliance.On the basis of introducing the concept of reconciliation and compliance,carbon market reconcilia-tion and compliance should follow the principles of lawful administration,prioritizing public wel-fare,and honesty and trustworthiness.The construction of a carbon market reconciliation and com-pliance system should focus on three aspects:standard formulation,implementation and supervision of compliance plans,in order to promote the development of carbon market reconciliation and com-pliance practices.
