Dilemmas and Optimisation Paths of Judicial Application of Ecological Environment Restoration Responsibility
The responsibility of ecological environment restoration,as a new way to bear responsi-bility,is an important means to relieve the damaged ecological environment.The function and na-ture of ecological environment restoration responsibility determine the important position of ecolo-gical environment restoration responsibility.From the current situation of legislation and judicial application,this paper summarizes the problem of ecological environment restoration responsibility.In terms of legislation,there are legislative deficiencies,and practical obstacles in judicial applica-tion,such as being trapped by traditional judicial concepts,imperfect fund standard system,inade-quate execution mechanism,and imperfect supervision system.Focusing on the current situation,it can be cracked by incorporating the ecological environment restoration system into the compilation of the environmental code,practicing the ecological restoration theory,improving the capital regu-lation system,optimizing the implementation mechanism and improving the supervision mecha-nism,so as to practice the concept of ecological environment restoration and write a new chapter in the construction of ecological civilization.
