Legislative Dilemma and Countermeasures for the Protection of Labor Rights and Interests of Flexible Employment Personnel on Platforms
Represented by normative documents issued by the Ministry of Human Resources and Social Security,China has made significant achievements in legislation on the protection of labor rights and interests of platform flexible employment personnel.However,there are also difficulties such as procedural emphasis over substance,formal emphasis over substance,and deviation between legislative focus and practical needs.We should take substantive fairness as the concept,promote the balance of interests between platforms and flexible employment personnel,and encourage them to fulfill their social responsibilities on the basis of respecting the organizational and management power of platforms;Reasonably regulate the platform's rights to interest distribution and labor rules making,and strengthen the fairness of platform interest distribution and rule making;Improve the supply of public goods in the fields of social insurance,occupational injury protection,and dispute resolution.
