Positioning and Qualification Certification of Satellite Image Evidence
Satellite image evidence is gradually being widely applied in the field of judicial practice in China.However,there are various practical models and conceptual differences in various regions,such as"documentary evidence","physical evidence",and"electronic data",regarding the positioning and utiliza-tion of evidence types.This has caused certain difficulties in the persuasiveness and even the unity and author-ity of basic concepts in the application of satellite imagery evidence.Based on the basic principles of evidence construction and distribution,the type of evidence in"satellite imagery"should be defined as"electronic da-ta".Based on the integration and unification of past beneficial practical experience,and based on basic litiga-tion legal positions such as the trial center,procedural justice,and protection of human rights,the principles of sufficient debate and effective defense should be established.The substantive and procedural certification norms for the adoption and exclusion of satellite imagery evidence qualifications should be clarified.
