增材制造技术下的专利侵权追责困境与出路

增材制造技术作为数字工业时代的产物令传统贸易的生产供应链完全颠覆,打破了传统制造业空间与人力资源的限制,为远程贸易和个性化定制生产制造注入了新的活力.但由于其生产方式的隐蔽性和互联网依赖的广泛性滋生了大量专利侵权现象,受限于专利权的地域性和专利制度的滞后性,传统专利法体系不足以应对新型生产技术带来的挑战,增材制造技术在全球范围内引起的专利侵权问题陷入了救济和追责的困境.摒弃产品必须有形化的传统界定方式,承认数字化专利产品形式,建立数字专利侵权制度和以预防专利侵权风险为导向的监管体制,是解决目前增材制造技术带来专利侵权困境的优选路径.
Abstract
As a product of the digital industrial era,digital manufacturing technology has completely subverted the production and supply chain of traditional trade,breaking the limitations of traditional manufacturing space and hu-man resources,and injecting new vitality into remote trade and personalized customized production and manufactur-ing.However,due to the concealment of its production methods and the extensive reliance on the Internet,a large number of patent infringements have occurred.Limited by the regional nature of patent rights and the lag of the pa-tent system,the traditional patent law system is not enough to cope with the challenges brought by new production technologies.The patent infringement issues caused by digital manufacturing technology on a global scale have fall-en into the dilemma of relief and liability.Abandoning the traditional way of defining products that must be tangi-ble,recognizing the form of digital patented products,establishing a digital patent infringement system and a regu-latory system oriented to preventing patent infringement risks are the preferred paths to solve the current patent in-fringement dilemma caused by digital manufacturing technology.
