With the swift advancement of computer technology,the derivative information that can be generated by big data is progressively increasing under the extensive correlation and in-depth mining.The derived information is the generalization of common characteristics of individuals,reflecting the"recognizability"of individual,organizational and even social features,which should be re-examined and receive more attention.By introducing the concept of community information,this paper indicates that big data encompasses the community content of individuals,and the derived information may achieve unauthorized information acquisition of their community units,entailing the risk of intellectual property infringement.As the derivative information of data products,it often possesses the attributes of community rights,diversity,concealment and high value.Therefore,it is challenging for the subjects of relevant rights to predict the infringement and take more proactive defensive measures in advance.Consequently,in order to achieve the goal of protecting the benefits of right holders,promoting the usage and circulation of big data and ensuring the prosperity of the digital market,it is necessary to enhance the administrative supervision system for the collection and utilization of big data from the source,establish judicial protection rules for its derivative information,and enhance the awareness of information rights and self-regulatory review ability of the data industry.
