Research on Social Insurance Issues for Flexible Employment Personnel From the Perspective of Equal Rights Protection
The right to equality,as a fundamental right of citizens,also applies to the field of social insurance payments.From both the perspective of realizing the right to social security and the legal basis of the social insurance system,the current system's practice of excluding flexible employees from entering the employment injury insurance and unemployment insurance systems violates the requirements of equal rights protection The differential treatment of flexible employment personnel in Basic Endowment Insurance and Basic Medical Insurance for employees not only does not conform to the attributes of social insurance,but also has no legal basis and contradicts the national policy.Therefore,it is urgent to adjust the current employee social insurance system to include flexible in employment injury insurance system,stipulate that flexible employees enjoy basic endowment insurance at the same age as normal employees,establish an incentive mechanism for"more and long contributions"to link premiums with benefits,abolish the relevant regulations on the waiting period for flexible employees to enjoy basic medical insurance benefits for normal employees,gradually construct an unemployment security system that is suitable for its employment characteristics,and promote the healthy development of various flexible employment methods.
