Research on the Compliance Probation System under the Call for the Return of Substantive Criminal Law
In the reform practice of the criminal compliance system regarding the involved enterprises,we should still abide by the principle of statutory punishment despite the tendency towards the mode of post factum crime,and explore the basis of the substantive law supporting enterprise compliance.Adding relevant provisions of unit compliance probation system in criminal law is conducive to promoting compliance reform in depth,and is also beneficial to grasp the substantive function of probation system,so as to meet the dilemma of the lack of incentive mechanism faced by compliance reforms.At the level of entity system,the compliance probation system should not be decoupled from the natural person probation system,and at the same time,we should first try to make principled provisions.In the practice process,the court should actively coordinate with the third party mechanism to realize the due value of the compliance probation system.
