Evidence and definition of the legal concept of biodiversity damage
The"Opinions on further strengthening biodiversity conservation"clearly puts forward the requirement to improve the methods and work mechanisms for identifying and assessing biodiversity damage.However,the legal conceptual clarification and definition of"biodiversity damage"is currently in a research vacuum.Based on which,this paper attempted to identification and definition the legal concept of"biodiversity damage"from the following three dimensions:the differentiation between"ecology"and"environment"in legal connotation,the distinction between biodiversity damage and natural resource damage in legal definitions,and the differentiation between biodiversity damage and environmental element damage in terms of intrinsic structure,so as to provide sufficient theoretical evidence for the independence of the legal concept of biodiversity damage.In the process of advancing the scientific concept of biodiversity damage to a legal concept,it is necessary to process and transform the scientific concept of biodiversity damage to highlight the unique value attributes of biodiversity damage in legal terms.
