摘要
环境信息知情权作为《奥胡斯公约》中重要的程序性环境权,在我国林业碳汇项目中没有得到完备保障.检视静态法律规定与动态项目实践,存在权利保障规定滞后、获取信息渠道不畅、泛化环境保护概念等现实困境.总结域外REDD+项目经验,确定保障知情权所需的林业碳汇信息范畴,为立法完善信息披露制度、树立环境事务衔接边界、规范碳汇信息披露主体责任、提高林业碳汇信息获取能力建设提供对策,以保障弱势利益相关人在林业碳汇项目中的知情权.
Abstract
The right to environmental information,as an important procedural environmental right in the Aarhus Conven-tion,has not been fully protected in China's forestry carbon sequestration projects.Upon examining static legal provisions and dynamic project practices,there are practical difficulties such as outdated rights protection regulations,poor access to information channels,and generalization of environmental protection concepts.Summarize the experience of REDD+projects outside the region,determine the scope of forestry carbon sink information required to safeguard the right to know,and pro-vide countermeasures for legislation to improve the information disclosure system,establish environmental affairs connection boundaries,regulate the main responsibility of carbon sink information disclosure,improve the ability to obtain forestry car-bon sink information,and protect the right to know of vulnerable stakeholders in forestry carbon sink projects.
