Research on Anti-monopoly Review System of Data-driven Business Concentration
The data-driven concentration of operators has dual effects,and the positive effects fit the legislative spirit of anti-monopo-ly law.The negative effects of monopolizing necessary data,reducing consumer welfare and blocking innovation violate the leg-islative purpose of the anti-monopoly law and need to be regulated by the anti-monopoly law.When conducting anti-monopoly review on data-driven concentration of operators,the scope of review is too narrow,the relevant market is difficult to delimit,and the relief measures are not good enough to restrict the decision of review.In view of the particularity of data-driven concen-tration of operators,it is necessary to increase the transaction volume criteria to broaden the scope of examination,adopt rele-vant market definition methods that are consistent with the characteristics of data-driven enterprises,and improve the antitrust examination focus of law enforcement agencies.
