The Operational Mechanism of Local Legislative Procedure and Its Perfection
In the narrow sense,the local legislative procedure refers specifically to a series of steps taken by the Local People's Con-gress and its Standing Committee to formulate the local laws and regulations,under the principle of"Non-repetition","Non-conflict"and"Regional Collaborative Legislation",both democratic legislation and scientific legislation should be taken into ac-count.According to the different stages of proposal,deliberation,voting and publication,the corresponding operational mech-anisms,such as filtering mechanism,order mechanism and legislative research mechanism,can guarantee the scientific or dem-ocratic nature of the local legislative process.However,the operating mechanism of the local legislative procedure is more in the sense that it should be,there are so many problems in the local legislative procedure that it is difficult to meet the require-ments of participation,negotiation,rationality.To perfect the local legislative procedure,we should not only strengthen the operability of procedural norms and increase the supply of norms,but also realize the interconnection of democratic legislation and scientific legislation in the operational mechanism,finally,it is necessary to set hard standards for the local legislative process and enhance the mandatory nature of the process.
