Analysis on the Way to Realize the Security Value of Law
In the digital age of today's risk society,the security value of law attracts people's attention,and the path to realize the security value of law is worth exploring.From the perspective of the transformation of social structure,the change of security values and the transformation of legal forms,there are three paths to realize the security value of law:the duty-based path,the individual-based right path and the social-based right path.These three paths are respectively generated in the form of repres-sive law,autonomous law and responsive law;accordingly,it embodies the order-based security values,freedom-based security values and comprehensive security values.At present,the legal form of China is changing from the autonomous law to the re-sponsive law,and the security values are changing from the liberal security values to the comprehensive security values,the Way of realizing the security value of law is in the process of changing from the individual-oriented right path to the social-ori-ented right path.In view of the problems existing in the path of realizing the security value of China's law,it needs to be solved from the aspects of optimizing the comprehensive security value concept,perfecting the responsive legal form and adjus-ting the path of realizing the security value of law.
