摘要
污染环境犯罪是在经济与社会剧烈转型期呈现的复杂问题,犯罪治理需考虑经济、社会、生态环境法益的均衡.污染环境犯罪具有深刻的经济与社会根源,多样主体实施污染环境犯罪行为的动机与路径存在显著差异,犯罪治理不能是单一的线性模式.依据犯罪主体的犯罪行为类型及生成路径,需建构包括严格管控型治理、转型引导型治理与监督合规型治理在内的分层治理模式.该模式中涵括刑事立法、刑事司法、行政执法、刑事社会政策、刑事合规制度、企业合规体系、合规环境建设、转型政策支持、市场调节等多元机制.深入探索污染环境犯罪行为典型的生成路径,建构犯罪治理的多元分层治理模式,有助于生态环境犯罪的精准化治理,推动我国经济、社会、生态文明的整合发展.
Abstract
Environmental pollution crime is a complex problem in the drastic transition period of economic and social transformation,and the crime governance should consider the balance of economic,social and ecological and environmental legal interests.Envi-ronmental pollution crime has profound economic and social roots,and the motives and paths of various subjects to commit en-vironmental pollution crime are significantly different,so the crime governance cannot be a single linear mode.According to the type of criminal subjects and the generation path of criminal behavior,it is necessary to construct a stratified governance mode of strict control governance,transformation-guided governance and supervision and compliance governance.The stratified gov-ernance model includes criminal legislation,criminal justice,administrative law enforcement,criminal social policy,criminal compliance system,enterprise compliance system,compliance environment construction,transformation policy support,mar-ket regulation and other multiple mechanisms.Exploring the typical path of the generation of environmental pollution crimes and constructing the multi-layered governance mode of crime governance are conducive to the precise governance of ecological and environmental crimes and promoting the integrated development of China's economic,social and ecological civilization.
