脑机接口技术具有提升人类健康和福祉的巨大潜力,但其应用可能引发人身损害、精神损害及干预意思自治等风险.成因在于人脑脆弱性与技术危害性相叠加、精神私密性与读脑必要性相对立以及科技创新性与法律滞后性相冲突.因此,应采用动态知情同意模式,医务人员应充分且持续地履行说明义务,并阶段性评估患者的知情同意能力,视情况决定是否需要重新取得同意授权;应构建人类神经权利体系,包括精神隐私权、精神完整权和自由意志权;应完善民事法律行为规则,法律应承认自然人可以通过脑机接口技术作出意思表示.自然人在因设备故障或外界干预而作出不符内心真意的意思表示时,应享有撤销权,且应根据相对人是否知情进行区别保护.
Application Risks and Legal Regulations of Brain-Computer Interface Technology
Brain computer interface technology has great potential in improving human health and well-being.However,its applications may pose risks such as physical harm,psychological damage,and interference with autonomy of will.The underlying causes lie in the overlap between the brain's vulnerability and the potential dangers of the technology,the conflict between spiritual privacy and the necessity of reading the brain,and the tension between technological innovation and legal lag.Therefore,a dynamic informed consent model should be adopted,and medical personnel should fully and continuously fulfill their obligation to explain,and periodically evaluate the patient's ability to give informed consent,and decide whether to obtain consent authorization again depending on the situation.It also needs to establish a human neural rights system,including the rights to mental privacy,mental integrity,and free will.The rules of civil juristic act should be improved,and the law should recognize that natural persons can make an expression of intent through brain computer interface technology.A natural person should have the right of revocation when they make an expression of intent that does not reflect their true intention due to equipment malfunction or external interference,and differential protection should be provided based on whether the other party is aware of the situation.
