智慧教育场景下教育公平的变化、诉求与法治保障

智慧教育场景下的教育公平被赋予了"数字"与"智慧"方面的新内涵,展现出新的变化,并在起点、过程、结果三个阶段分别呈现出全覆盖性与倾斜性、去中心化与开源性、过程性与自适应性等特征.然而在实践中,智慧技术在消解既定的约束性因素时衍生出新的教育公平问题,如受教育机会请求权的不充分不均衡、受教育条件权实现的算法限制与异化、受教育成功权实现的评价体系待转变等,凸显出新时期教育公平各阶段的受教育权利诉求.由于权利保障是法治思维的基本内容之一,保障公民受教育权应与规范社会活动的法律法规紧密联系,因此针对不同阶段的受教育权利诉求,在立法上应不断推进理念转型,在执法上应不断强化责任落实,在司法上应加快构建维权机制.于此,才能从根本上实现智慧教育不同阶段的公平,有效回应数字鸿沟对教育公平造成的侵害.
The Change,Appeal and Legal Guarantee of Educational Equity in the Context of smart education
In the smart education scenario,educational equity is given the"number"and"wisdom"new connotation,there is a new change,and in the starting equity,process equity,result equity three levels presented a full coverage and tilt,decentralization and open source,process and adaptive characteristics.These characteristics reflect the long-term goal of equity in smart education.In real-ity,however,smart technology in the process of eliminating established binding factors derived new education equity problems,such as imsufficiency of claims for educational opportunities,algorithm restriction of the right to education conditions,the evaluation system of realizing the right to success in education needs to be changed,etc..Due to the right protection is one of the basic contents of the rule of law thinking,guaranteeing the equal digital eeducation rights of citizens must be connected with the laws and regulations regulating so-cial activities,Therefore,according to the right of education in different stages,the concept transformation should be continuously pro-moted in legislation;the responsibility should be strengthened in law enforcement;and the construction of rights protection mechanism should be accelerated in justice,only through the rule of law,can fundamentally realize the equity of smart education and effectively re-spond to the infringement of the digital divide.
