Towards Diversified Co-governance:The Construction Logic of Modern International Legal System
Against the backdrop of unprecedented changes in the international situation,the traditional state centered le-gal structure has obvious drawbacks and is particularly susceptible to being influenced by"polarized politics",leading to binary opposition between countries and reducing the authority and effectiveness of international law,which is not conducive to main-taining orderly cooperation and competition among major powers.From the perspective of administrative practice,the concept of"international legal subject"should not be rigidly defined through dichotomy,emphasizing the inherent compatibility be-tween"obligations erga omnes"and the concept of"community with a shared future for mankind"in international law,and en-hancing the effectiveness of national governance based on the values of fairness and justice.Specifically,it is necessary to trans-form the political concept of the legitimacy and effective operation of the international legal structure and construct the interna-tional legal rule system through a governance model of pluralism and co-governance.Guided by the concept of a community with a shared future for mankind as its fundamental value,and through the prudent reconstruction of the international legal or-der,the aim is to achieve harmonious coexistence and prosperity among diverse subjects in the international legal system.Through reflective criticism of the hierarchical system of the origin and effectiveness of international law,it is aimed to main-tain a complex dynamic balance between international law and domestic regulations,and construct an international legal effec-tiveness system based on a diverse governance model.
