摘要
虚假诉讼检察监督作为新时期民事检察工作的重要内容,在案源发现、调查取证、认定标准、惩戒追责等方面存在的困难仍是当前司法实践中亟待解决的问题.探析虚假诉讼检察监督的实践现状,通过构建大数据平台拓宽案源、建立预防惩戒监督机制、探索完善惩罚性侵权赔偿制度立法、加强社会综合治理等多项措施完善检察监督路径,以精准监督和司法融合保障社会信用体系建设.
Abstract
As an important content of civil procuratorial work in the new era,the supervision of false litigation in procuratorial work still faces difficulties in discovering the source of cases,investigating and collecting evidence,determining standards,and punishing and holding accountable,which are urgent issues to be solved in current judicial practice.Exploring the practical status of false litigation procuratorial supervision,by building a big data platform to broaden case sources,establishing a prevention and punishment supervision mechanism,exploring and improving the legislation of punitive infringement compensation system,strengthening comprehensive social governance,and other measures to improve the procuratorial supervision path,so as to ensure the construction of social credit system with precise supervision and judicial integration.
