监检衔接关系中检察权提前介入研究

摘要
现阶段,检察权提前介入监察调查已经是既存的客观事实,监检两机关对检察权的提前介入也持肯定的态度.自设立国家监察委之后,已有多起职务犯罪案件经过商请检察机关对国家监察委的办案工作提前介入.实践证明检察权提前介入的功能价值在于实现法法衔接,贯彻刑事诉讼证据标准,防止出现"以调查为中心"的局面,促进"以审判为中心"诉讼制度的改革进程.但是检察权"提前介入"程序并未在《监察法》和《刑事诉讼法》的规定中详细确认.鉴于理论和现实需求,有必要通过立法对该机制的法律地位予以明确,并在司法解释中细化和完善其基本操作流程,继续让其发挥提升办案质量的效能.
Abstract
At present,the early intervention of the procuratorial power in supervision and procuratorate is an objective fact that already exists.The supervisory and procuratorial organs also hold a positive attitude towards the early intervention of the procuratorial power.Since the establishment of the National Supervisory Commission,multiple cases of job-related crimes have been negotiated with the procuratorial organs to intervene in advance in the handling work of the National Supervisory Commission.Practice has proven that the functional value of early intervention of the procuratorial power lies in achieving the connection between law and law,implementing the standards of criminal litigation evidence,preventing the situation of"investigation centered",and promoting the reform process of the"trial centered"litigation system.However,the"early intervention"procedure of the procuratorial power has not been detailed in the provisions of the Supervision Law and the Criminal Procedure Law.Given the theoretical and practical needs,it is necessary to clarify the legal status of this mechanism through legislation,and to refine and improve its basic operational procedures in judicial interpretation,in order to continue to enhance its effectiveness in improving the quality of case handling.
