监察程序中非法证据排除的理论研究与实践进路——以《监察法》第33条第3款为视角

我国《监察法》以"对标"刑事诉讼证据体系的方式创设了监察程序中的"非法证据排除规则",实现了对于非法证据进行排除的"监审一体化",不仅能够体现"以审判为中心"诉讼制度改革的根本意志,而且也能使监察机关进行有效的自我监督、自我制约.《监察法》第33条第3款中规定的"非法证据排除规则"为监察调查与刑事司法提供了证据方面的衔接依据,但还需进一步细化.为保障监察程序中的非法证据排除规则得到有效实施,应当兼顾司法与监察整体规律与秩序,在监察机关内部设置相对分离的"二元主体",也应重视诉讼程序中司法机关对监察证据合法性的"外部审查"等.
Abstract
The Supervision Law of the People's Republic of China establishes the"exclusionary rule of illegal evidence"in the supervision procedure by marking the evidence system of criminal proceedings,realizing the"integration of supervision and trial"to exclude illegal evidence.Not only can reflect the fundamental will of the"trial-centered"reform of the litigation system,but also enable the supervisory organs to carry out effective self-supervision and self-restraint.The"rule of exclusion of illegal evidence"stipulated in Article 33,paragraph 3,of the Supervision Law provides a basis for the convergence of evidence between supervision investigation and criminal justice,but it needs to be further refined.In order to ensure the effective implementation of the rules for the exclusion of illegal evidence in the supervision procedure,we should take into account the overall law and order of the judiciary and supervision,set up relatively separate"dual subjects"in the supervision organ,and pay attention to the"external review"of the legality of the supervision evidence by the judicial organ in the litigation procedure.
