摘要
当下,生成式人工智能得到广泛应用,但由于其技术特性和系统复杂性,由其引发的侵权风险逐步显现,并在一定程度上挑战法律秩序、冲击社会伦理,影响社会公平和谐.现阶段,对生成式人工智能引发侵权风险的法律治理,需坚持多主体参与、依法治理、以人为本等基本原则.基于此,政府部门、行业协会、企业及社会公民都应积极参与生成式人工智能的法律治理,明确自身主体职责,协同优化侵权职责认定标准、健全审查监管机制、调整规则完善法律救济,全方位推动生成式人工智能引发侵权风险法律治理的高质量落实.
Abstract
At present,the legal governance of the infringement risks triggered by generative artificial intelligence should adhere to basic principles such as multi-party participation,governance according to law,and people-oriented approach.Based on this,government departments,industry associations,enterprises,and social citizens should actively participate in the legal governance of generative artificial intelligence,clarify their own responsibilities,coordinate to optimize the determination standards of infringement responsibilities,improve inspection and supervision mechanisms,and adjust rules to perfect legal remedies,comprehensively promote the high-quality implementation of legal governance of infringement risks triggered by generative artificial intelligence.
