摘要
刑事案件赔偿保证金提存制度从2008年被提出后就被全国各地的检察机关及公证机关高频率适用,其在节省赔偿实现的时间,保障被害人索赔更加便捷地实现,维护双方合理公平的赔偿三方面有着独特价值.由于地区之间实践的差异,该制度从外观到内容存在提存规定繁杂、先后次序不明、涵摄范围模糊以及基本内容不清等问题.因此,科学构建提存程序的流程图,划定提存案件的适用条件,丰富制度内容的含义,对于双方当事人正确适用赔偿保证金提存制度,积极化解社会矛盾起到重要作用.
Abstract
Since its introduction in 2008,the system of deposit of compensation deposits for criminal cases has been frequently applied by procuratorial organs and notary offices across the country,and it has unique value in saving the time for compensation realization,ensuring that victims'claims can be realized more conveniently,and maintaining reasonable and fair compensation for both parties.Due to the differences in practice between regions,the system has problems such as complicated deposit regulations,unclear priority,ambiguous scope and unclear basic content from appearance to content.Therefore,scientifically constructing the flow chart of the deposit procedure,delineating the applicable conditions of the deposit and withdrawal cases,and enriching the meaning of the system play an important role in the correct application of the compensation deposit system by both parties and the active resolution of social contradictions.
