现行被害人法律援助制度之补阙

摘要
《法律援助法》规定刑事案件的被害人有权获得法律援助,标志着我国法律开始关注到被害人应当与犯罪嫌疑人、被告人一样享有法律援助权.但是《刑事诉讼法》对被害人的法律援助并未作出规定.《法律援助法》规定对被害人法律援助的定位不清、门槛过高.实践中,被害人参与刑事诉讼的权利常常被忽视,被害人要获得法律援助障碍重重.为使被害人有效参与诉讼,更好体现司法公平正义,应确立以保障被害人辩论权实现为指导理念,完善被害人法律援助制度,降低法律援助门槛,提高法律援助服务质量.
Abstract
The Law on Legal Aid stipulates that victims of criminal cases have the right to legal aid,which indicates that Chinese law has begun to pay attention to that victims should enjoy the right to legal aid as suspect and defendants.However,the Criminal Procedure Law does not provide for legal aid for victims.The Legal Aid Law stipulates that the positioning of legal aid for victims is unclear and the threshold is too high.In practice,the right of victims to participate in criminal proceedings is often overlooked,and there are numerous obstacles for victims to obtain legal aid.In order to enable victims to effectively participate in litigation and better reflect judicial fairness and justice,it is necessary to establish the guiding concept of safeguarding the realization of victims'defense rights,improve the legal aid system for victims,lower the threshold for aid,and improve the quality of aid services.
