以情感计算为基础的智能化再犯风险评估工具,在人机交互中可自动捕捉人类面部表情、姿态变化及生理反应,体察个体情绪变化,揣测行为意图,形成预期并表达反馈信息,为新时代犯罪治理注入了新动能.但囿于技术缺陷,仍面临诸多侵权风险、法理质疑和伦理挑战.为促进智能化评估技术在刑事司法领域的合规、高效与可持续发展,应拟合多学科专业知识优化技术模型,构建全生命周期的伦理监管体系,打造立体化的司法应用场景规制方案,实现对犯罪行为的同时态感知、同频度防控.
The intelligent recidivism risk assessment tool based on emotional computing can automatically capture human facial expressions,posture changes and physiological responses in human-computer interaction,sense individual emotional changes,speculate behavioral intentions,form expectations and express feedback information,and inject new momentum into crime governance in the new era.However,due to the technical defects,it still faces many infringement risks,legal questions and ethical challenges.In order to promote the compliant,efficient and sustainable development of intelligent assessment technology in the field of criminal justice,it is necessary to fit the multi-disciplinary professional knowledge optimization technical model,build the ethical supervision system of the whole life cycle,create a three-dimensional judicial application scenario regulation scheme,and realize the simultaneous perception of criminal behavior and the prevention and control of the same frequency.
