摘要
促进"阳光复议"、助推行政复议成为化解行政争议主渠道,公开行政复议决定是大势所趋.复议工作要以公开为常态,坚持公共利益优先,坚持高效便民原则,保障高效与便民相统一.实体上应引入国家秘密特殊审查程序,严格界分个人信息与个人隐私,严格界定"国家安全"概念,制定各领域国家安全的判断标准.程序上应设置复议机关及时告知义务与行政复议相对人提出书面意见、再次复议以及另行起诉、申诉的权利.
Abstract
Promoting"sunshine reconsideration"and promoting administrative reconsideration has become the main channel to resolve administrative disputes,and it is the general trend to publicize administrative reconsideration decisions.The review work should be open as normal,adhere to the public interest priority,adhere to the principle of efficient convenience,and ensure the unity of efficiency and convenience.Entities should introduce special review procedures for state secrets,strictly distinguish between personal information and personal privacy,strictly define the concept of"national security",and formulate criteria for judging national security in various fields.In the procedure,the reconsideration organ should be set up to inform the obligation in time and the administrative reconsideration counterpart to put forward written opinions,reconsideration and the right to Sue and appeal separately.
