《The Opinions on Several Issues Concerning the Determination of Sentencing Circumstances such as Voluntary Surrender and Meritorious Deeds in Handling Duty-related Criminal Cases》have already stipulated the criteria of meritorious deeds,but the source of clues for meritorious deeds and the conditions for determining the validity of such cases are insufficiently stipulated in judicial interpretations.Moreover,the contents of this legal determinations are almost ambiguous and cannot meet actual needs.This article takes"the Yueqing-8·26-case"for example,attempting to reveal the deficiencies of substantive and procedural legitimacy in determination of such cases,and expecting to provide a new perspective for judicial application of the meritorious deeds.
