From the nature of the divorce property ownership agreement,it can not be simply identified as a gift of contract,but should consider its unique identity and attributes to be regarded as a divorce property settlement agreement.The divorce property agreement obligee can exclude the obligee of the nominal obligee of the property from enforcement if the following conditions are met:The divorce agreement has taken effect before the claim of the applicant for execution,the divorce agreement divides the community property reasonably,the right holder has occupied the property involved before the seizure,the right holder has not handled the transfer registration for no fault,and the claim of the applicant for execution is an ordinary monetary obligation.
