未成年刑事被害人权利保护现状及完善路径

摘要
当前,我国未成年刑事被害人数量和占比不断上升,却未能得到应有的保障,其主要问题在于立法规定和司法实践中法律援助制度、合适成年人到场制度和社会组织的参与不够充分.对于未成年刑事被害人的权利保护,应当通过扩大法律援助适用范围和健全法律援助经费保障机制来完善法律援助制度,确定合适成年人到场顺位和保障未成年刑事被害人的交流权来完善合适成年人到场制度,建设社会保障体系,大力推进未成年刑事被害人保护全社会多方参与,组建专业团队提供相关服务等方面予以完善,从而切实保障未成年刑事受害人的权利.
Abstract
At present,the number and proportion of juvenile criminal victims in China are not properly guaranteed,but the main problem is that the legal aid system,the appropriate adult attendance system and social organizations are not fully participated.For the protection of the rights of juvenile criminal victims,the legal aid system should be improved by expanding the scope of legal aid application and improving the guarantee mechanism of legal aid funds,determining the priority of the presence of suitable adults and protecting the communication rights of juvenile criminal victims to improve the presence of suitable adults,and building a social security system.We will vigorously promote the participation of the whole society in the protection of juvenile criminal victims,set up professional teams to provide relevant services and improve them,so as to effectively protect the rights of juvenile criminal victims.
