Algorithm Risk and Legal Regulation of Digital Platform from the Perspective of Law and Economics
The digital platform gained new development opportunities during the COVID-19,and the digital economy continued to improve.The digital platform utilizes algorithmic tools to analyze users'historical data,providing personalized services to users,facilitating their lives,and improving the quality of life.However,under the control of intelligence and platform,algorithms may exceed the scope of technical tools,causing legal risks such as privacy infringement,information cocoon,algorithm discrimina-tion,and algorithm monopoly.Digital platforms are still in the market and regulated by market order,so using theories of economics can grasp more accurately the effect of the causes,hazards,and legal regulation of digital platform algorithmic risks.To prevent and control the algorithmic risks of digital platforms and improve the legal regulation of platform algorithms,it is necessary to improve the"digi-tal human rights"mechanism,establish an algorithmic review mechanism,and construct an institution to manage algorithms and seek justice to supervise the legitimate operation of digital platforms and en-sure the healthy development of the digital economy.
