摘要

产权是影响历史文化街区保护更新实施成效的重要因素,但关于产权重构模式,学术界一直存在争议.昆明市文明街历史文化街区在保护更新历程中存在三种不同的产权治理模式,三种模式均有其特殊的历史背景和历史贡献,但无法持续推动街区的保护更新实施.该研究从房屋产权复杂、交易成本过高、国家政策变化三个方面剖析了当前文明街保护更新的困境,从推动"政企民"多方参与,明确主体权利义务、调整优化产权权利束三个方面提出了保护更新路径的思考,以期对国内历史文化街区保护更新实施中的产权治理方式提供有益参考.

Abstract

Property rights is a crucial aspect influencing the success of preservation and rejuvenation of historic conservation area,nevertheless,there exists academic debate concerning the property rights models for reconstruction.During the effort to safeguard and revamp Kunming Wenming Street historic conservation area,three distinct approaches to property rights management are discernible.Although each of these modes possess unique historical roots and contributions,none of them can ensure that conservation and renewal of the historic conservation area is sustainable.We examine the challenge facing the preservation and revitalization of Wenming Street historic conservation area.We also analyze the issue from three angles:intricate property rights,high transaction costs,and shifts in national policies.Then we propose a protection and renewal strategy focused on three approaches.These methods include increasing the participation of"government,enterprise and the people",clarifying the rights and obligations of the primary parties,and adjusting and optimizing the bundle of property rights.The aim of this strategy is to promote an improved understanding of the implementation of property rights governance for the preservation and revitalization of the historic and cultural district in the domestic property market,so as to offer valuable guidance for managing property rights in the protection and restoration of domestic historic conservation area.
