Research on the Establishment of an Incentive System for the Construction of the Rule of Law with Chinese Characteristics
Incentive is one of the basic functions of law,and the establishment of an incentive system for the construction of the rule of law with Chinese characteristics is of great significance for improving the structure of socialist legal norms with Chinese characteristics,solving the problem of insufficient endogenous motivation for the construction of the rule of law,and promoting the modernization of the national governance system and governance capacity.So far,China has multiple laws and regulations that provide principles for incentive systems,and has accumulated some experience in the application of incentive systems.In ad-dition,there are also successful experience to learn from foreign countries and regions,and it is highly feasible to establish an incentive system for the construction of rule of law with Chinese characteristics.The establishment of an incentive system for the construction of the rule of law with Chinese characteristics should follow the principles of scientification and systematization,spiritual incentives as the mainstay and material incentives as supplements,and procedural fairness and openness.The specific design and construction of this system should start from several aspects,such as selecting the legislative model of incentives,de-termining the scope of incentives,increasing the types of incentives,optimizing the ways of incentives and setting up the pro-grams of incentives.
