行政规范性文件制定程序的违法认定:条件、标准与限度

摘要
制定程序是行政规范性文件违法认定的要件之一.在附带审查制度中,行政规范性文件制定程序违法认定的启动,首先应该满足附带审查诉讼系属成立这一客观条件,具体表现为行政行为的可诉性与行政规范性文件的可审查性两个方面.基于附带审查制度的功能定位、当事人诉讼程序权利的保障,以及诉讼效率与主动审查能力的限制等缘由,行政规范性文件制定程序违法认定的启动,也存在当事人诉讼理由处分的主观条件.区别于个体化的行政程序,群体性、政策化的行政规范性文件违法认定具有一定的克制性,因此"正当程序"不宜作为制定程序违法认定的标准."严重违反制定程序"认定标准,是一个兼容形式与实质审查的审慎标准.在适用的内在逻辑上,包括程序"范围"上的有限审查与"程度"上的实质审查两个方面;在构成的影响因素上,需要综合考虑制定程序的价值功能和行政规范性文件的法律地位两个方面.制定程序与行政规范性文件合法化之间的勾连关系,既产生了制定程序违法认定的正当性问题,也形成了制定程序违法认定的豁免即限度问题."法律效力""实体权益"与"合理事由"是制定程序违法认定限度的具体判别基准.
Abstract
The formulation of procedure is one of the requirements for the illegal identification of administrative normative docu-ments.In the incidental review system,the start of the illegal identification of the administrative normative document formulation procedure should first meet the objective condition of the establishment of the incidental review litigation,which is manifested in two aspects:the accessibility of administrative acts and the reviewability of administrative normative documents.Based on the functional positioning of the attached review system,the guarantee of the parties'litigation rights,and the limitation of litigation efficiency and review ability,the initiation of the illegal determination of administrative normative document also has the subjec-tive conditions for the punishment of the parties'litigation reasons.Different from individualized administrative procedure,the il-legal identification of group and policy-based administrative normative document has a certain degree of restraint.Therefore,"due process"should not be used as the standard for the illegal identification of procedure."Serious violation of the establishment of the procedure"identification standard is a prudent standard for compatibility form and substantive review.In the inherent logic of application,it includes two aspects:limited review of the"scope"of the procedure and the substantive review of the"de-gree";in terms of the influencing factors,it is necessary to comprehensively consider from the two aspects of the value function of the formulation of the procedure and the legal status of administrative normative document.The relationship between the for-mulation of procedure and the legalization of administrative normative document not only creates the issue of the legitimacy of the illegal identification of the formulation procedure,but also creates the issue of the exemption or bound of the illegal identifi-cation of the formulation procedure."Legal effect","physical rights and interest"and"reasonable cause"are the specific criteria for determining the bound of illegal identification of procedure.
