摘要
有赖于社会分工的不断细化和互联网技术的快速发展,市场中的反竞争共同违法行为频发,尤其是帮助性不正当竞争行为泛滥成灾.对直接实施者以外的行为人进行责任追究属于竞争法规制范围的扩张,因此针对"帮助实施"行为这一竞争法规制的全新场域,要充分考虑竞争法领域特性和市场竞争实际,明晰处罚依据和行为认定在反竞争共同违法理论中的关键地位.帮助性不正当竞争行为作为反竞争共同违法行为的一部分,对该行为的认定需要通过帮助行为客观表现和行为人主观状态进行实质的违法性判断,明晰该行为作为反竞争共同行为需充足的共同要素及程度.
Abstract
Depending on the continuous refinement of the social division of labor and the rapid development of Internet technolo-gy,anti-competitive joint violations are frequent in the market,especially the proliferation of aiding unfair competition.The ac-countability of actors other than the direct implementer belongs to the expansion of the scope of the competition law,therefore,for the brand-new field of the competition law,we should fully consider the characteristics of the field of the competition law and the actual market competition,and clarify the basis of the punishment and the identification of the behaviors in the theory of anti-competitive joint violation.As a part of the anti-competitive common illegal behavior,the determination of this behavior needs to judge the substantive illegality through the objective performance of the helping behavior and the subjective state of the perpetrator,and to clarify the common elements and the degree of adequacy of this behavior as an anti-competitive common ille-gal behavior.
