摘要
我国涉案企业合规改革试点工作开展以来,菏泽市人民检察院在办案质效、机制建设、行刑衔接等方面取得了显著成效,形成了"一体化推进、专业化立制、多元化联动、精细化办案"工作思路.目前,菏泽市在涉案企业合规改革中,存在涉案企业合规主体如何认定、如何监督与制约检察院权力以及第三方监督评估机构如何履职等问题.为此,菏泽市人民检察院应深刻理解企业合规制度的理念和价值,提升社会治理成效,提升办案水平,强化内外部监督,进一步探索涉案企业本土合规模式,推进涉案企业合规改革向纵深发展.
Abstract
Since the pilot work of compliance reform in enterprises involved in cases began in China,the Peo-ple's Procuratorate of Heze City has achieved significant results in case handling efficiency,mechanism construc-tion,and judicial-executive coordination,forming a working train of thought of"integrated promotion,profession-al institutionalization,diversified linkage,and refined case handling".Currently,in the compliance reform of en-terprises involved in cases in Heze City,there are issues such as how to identify the main body of compliance of en-terprises involved in cases,how to supervise and restrict the power of the procuratorate,and how third-party su-pervision and evaluation institutions fulfill their duties.Therefore,the People's Procuratorate of Heze City should have a deep understanding of the concept and value of enterprise compliance system,improve the effectiveness of social governance,enhance the level of case handling,strengthen internal and external supervision,further explore the local compliance model of enterprises involved in cases,and promote the deepening development of compliance reform in enterprises involved in cases.
