本文以案例为切入点,将民法典"自甘风险"规则在学校体育活动中的适用条件进行了解读.通过文中的案例得出适用"自甘风险"规则的构成要件有四个,缺一不可.
Abstract
This article uses cases as the starting point to explain the applicable conditions of the"assumption of risk"rule in the Civil Code in school sports activities.Based on the analysis of the cases in this article,it can be concluded that there are four constituent elements for the application of the"assumption of risk"rule,and none of them is indispensable.
