In the era of big data,the use of generative artificial intelligence(AI)to assist government automated deci-sion-making is a crucial topic in the construction of digital governments.As an algorithm-assisted tool,generative AI does not constitute independent machine decision-making in its own right;fundamentally,it remains within the existing legal frame-work of administrative decision-making.Digital technology acts as a"double-edged sword."While generative AI can enhance the efficiency of administrative decisions,it also poses challenges to the transparency,fairness,due process,and data security of such decisions if not carefully managed.To achieve a logical closure between technological empowerment and risk avoidance,it is essential to balance instrumental rationality with value rationality when integrating generative AI into government auto-mated decision-making processes.This involves optimizing administrative decision-making procedures,improving the per-sonal data security protection system,and incorporating generative AI-assisted decision-making into the rule of law.
