Online litigation is becoming an major achievement of judicial information reform,in which the liability of clarification for judge plays an important role.It can not only improve judicial efficiency,but also safeguard judicial justice and protect the rights of the relevant parties.Different from the dual attributes of judge clarification of in traditional litigation,it seems more appropriate to define the nature of judge clarification of online litigation as obligation.Under the civil litigation mode of following the adversary system,the principle of consent of the parties followed by the online litigation procedure depends on the performance of the judge's obligation to clarify.There are new changes in the content,exercise mode and timing of the judge's clarification obligation in online litigation.If the judge violates the obligation of clarification,which he should clarify but not clarify,and the parties should be given the right of appeal relief.
