The Embedding of Artificial Intelligence in the Rule of Law:A Jurisprudential Reflection of Intelli-gent Justice
The embedding of artificial intelligence(AI)in the rule of law is a product of the combination of techni-cal rationality and value judgment in the modernization process,and intelligent justice(IJ)is a concrete pres-entation of this combination in the judiciary.The embedding of AI in the judiciary brings both benefits and challenges.The connotation and position of intelligence technology in the judiciary should be explained based on the framework of an intelligent society.Judicial trial practice has unique institutional attributes and logical aspects.There are various feasible ways for AI technology to be applied to justice and promote judicial justice.Human-machine collaboration is the best prospect for IJ and can play a full role in the advantages of AI.We should construct a feasible human-machine collaboration model and picture under the digital rule of law frame-work,taking advantage of machine decision-making and reshaping judicial justice.
