宅基地复合利用是保障乡村居住和产业发展用地需求的重要途径。宅基地复合利用由宅基地管理制度、乡村产业用地特点、人口流动等因素共同作用所致,包括用途复合、主体复合和权利复合三种典型形态。宅基地用途复合和使用主体复合方面的探索比较全面,权利复合是实践探索的重点且聚焦在为非农户使用宅基地提供租赁之外的其他渠道和更有保障的权益。宅基地复合利用面临农房建设监管缺位、宅基地使用权主体扩大、宅基地使用权让渡有违权利派生逻辑等问题。基于宅基地复合利用面临的新形势,应健全宅基地用途管理制度、有条件赋予城镇居民更有保障的宅基地使用权、健全宅基地所有权人权益保障机制。
Typical Form,Practice Trend,and Institutional Arrangement of Composite Utilization of Homestead
The composite utilization of homestead is an important way to ensure the land demand for rural residential and industrial de-velopment.The composite utilization of homestead is caused by the combined effects of factors such as homestead management system,rural industrial land characteristics,and population mobility,including three typical forms:purpose composite,use subject composite,and rights composite.The exploration of the purpose composite and the use of the subject composite of homestead have been quite suffi-cient.The combination of rights is the focus of practical exploration,and it focuses on providing other channels beyond leasing for non-farmers to use homesteads and more secure rights and interests.The composite utilization of homesteads faces issues such as the lack of supervision over rural housing construction,the expansion of the subject of homestead use rights,and the violation of the logic of rights derivation in the transfer of homestead use rights.Based on the new situation faced by the composite utilization of homesteads,sugges-tions have been put forward from the aspects of improving the management system for the use of homesteads,conditionally granting ur-ban residents more secure use rights of homesteads,and establishing a mechanism for protecting the rights and interests of the owners of homesteads.
