As the importance of data as a factor of production is increasingly prominent,data property rights have become one of the most fundamental and core issues in the building and development of the data market.A data property rights system is essential for the building and development of the data market and the cultiva-tion of China's competitive advantage in the global digital economy.At present,the global data property rights system is still in its infancy,and many regions in China are also piloting the building of data property rights systems,the building of the data property rights system faces difficulties.For example,since multiple entities are involved in the data production process,the rules for confirmation of data ownership need to be improved considering different categories and grades;in view of the different confirmation and authorization practices of data ownership among different regions and departments,the institution for the system building needs to be im-proved;the complex development and application of data necessitates breakthroughs in the technologies.The building of the data property rights system should take fairness and efficiency into account while avoiding over protection.Meanwhile,data property rights should be clearly defined and divided,thereby forming a data prop-erty rights framework that is spatiotemporal and entity-specific.In addition,the legislation of data as a factor of production should be accelerated to fundamentally solve the problem of defining data property rights.The data property rights system should balance fairness and efficiency and achieve precise confirmation of data ownership.The technologies for confirmation of data ownership in multiple modules of the entire process should be innovated,so as to realize the traceability of data.
