摘要
基层综合执法改革经历了地方探索、中央推动、法律确认三个阶段.行政处罚权下放制度为基层综合执法改革提供了合法性.省级人大及其常委会、省级人民政府均有权决定基层综合执法改革,但考虑到下放权力的动态调整需求和行政效率因素,由省级人民政府行使决定权更有优势.为确保基层综合执法改革的合法性,应准确理解并严格执行改革的决定主体、适用条件、程序要求等制度.
Abstract
The reform of comprehensive law enforcement at the grassroots level has undergone three stages:local ex-ploration,promotion by Central Government,and legal confirmation.The system of decentralization of administrative penal-ty provides legitimacy for the reform of comprehensive law enforcement at the grassroots level.Provincial-level People's Con-gress and its standing committee,and provincial-level People's Government have the authority to make decisions on compre-hensive law enforcement reform at the grassroots level;however,considering the needs for dynamic adjustment of decentral-ization and administrative efficiency,it is more advantageous for provincial-level People's Governments to exercise its deci-sion-making power.In order to ensure the legitimacy of comprehensive law enforcement reform at the grassroots level,it is necessary to accurately comprehend and strictly follow relevant systematic requirements for the implementation of reform,such as decision-maker,applicable conditions,and procedural requirements.
