Study on the Building of a Legal System for Cohesion and Coordination of Supervision and Inspection over People's Congress Deputies
Deputies to People's Congress at all levels have the dual role attributes of public opinion endorsement and performance of public office,and play the dual role of supervision and bein supervised in the exercise of state power,which determines the particularity and complexity of deputies being subject to supervision.With the deepening of the reform of the supervision system,the legal dilemma of supervising and inspecting the performance of duties by deputies has become more prominent:the operational mechanism for the overall supervision of voters or electoral units in the original constituencies stipulated in the Constitution still needs to be improved;the functions of the People's Congresses and their standing commit-tees in managing and supervising the performance of duties by deputies have yet to be supported;the supervision organs have been extended to investigate and handle the daily performance of duties by deputies.Therefore,it is necessary to fol-low the spirit,principles and provisions of the Constitution,adhere to the overall logic of improving the coupling capacity of state institutions,functions and systems,and focus on the gaps and conflicts in the legal system related to the performance of duties by deputies,so as to scientifically determine the boundaries and limits of supervision of deputies'performance of duties,to enhance the consistency of orientation in the design of the legal system,and to build a harmonious legal system on the track of rule of law that supervises and guarantees the performance of duties and positive functions of the deputies.
