数字化时代行政裁量治理:价值、隐忧与法律规制

摘要
行政裁量治理在数字化时代机遇与挑战并存.机遇在于数字化带来了效率、精准、公平价值,挑战在于其技术上的嵌入难题、伦理上的价值冲突、权利上的法律风险等问题.对此,应当调整传统的行政裁量治理理念:从规范主义控权模式走向功能主义建构模式,并建立事前审查程序、事中运用裁量基准统一标准、事后备案审查的一体化规制路径.
Abstract
Administrative discretionary governance has both opportunities and challenges in the digit-al age.The opportunity lies in the efficiency,accuracy and fair value brought by digitalization,while the challenge lies in the embedded problems in technology,ethical value conflicts and legal risks in rights.In this regard,we should adjust the traditional administrative discretionary governance con-cept:from the normalism control mode to the functionalism construction mode,and establishing the integrated regulation path of pre-review procedure,the use of uniform standard of discretionary benchmark in the process of work and post filing review.
