摘要
以公共数据开放与利用为抓手是推动我国数据要素基础制度建设的重要举措.目前公共数据利用面临可用性低、基础制度缺失、市场机制单薄等现实困境.明确公共数据持有权是构建数据开放利用与治理体系的关键.基于公共数据持有权设立公共数据信托,通过引入数据运营商的受托人管理模式,公共机构与市场主体基于信托关系建立公私合作机制,运用技术手段保障数据安全管理与隐私保护,可以较为充分地发挥公共数据的经济与社会价值,赋能数字经济发展.
Abstract
Taking public data opening and utilization as the starting point is an important measure to promote the construction of China's data factor basic system.At present,the utilization of public data is faced with such realistic difficulties as low availability,lack of basic system and weak market mechanism.Clarifying the right to hold public data is the key to build an open data utilization and governance system.The establishment of public data trust based on the right to hold public data,the introduction of the trustee management mode of data operators,the establishment of public-private cooperation mechanism between public institutions and market entities based on the trust relation-ship,and the protection of data security management and privacy through technical means can give full play to the economic and social value of public data and empower the development of digital e-conomy.
