On the Legal Dilemma,Logical Starting Points and Construction Paths of Establishing Statutory Boards in China
As a new model of social governance,statutory boards have been introduced into China and piloted in special functional zones such as development zones around the country.A review of the practice reveals that the establishment of statutory boards in China is not standardized,and the unclear positioning of their nature leads to the confusion of their establishment logic.Statutory boards should be positioned as special authorized organizations,which undertake the integrated functions that government departments or other existing institutions can not effectively perform.The establishment of statutory boards requires clarifying their functional positioning,the legal basis and the principles to be followed.On this basis,the establishment system of statutory boards in China should be improved in terms of legislation,formation,authorization and other specific aspects,so as to regulate their establishment.
