On the Reconstruction of the Core Concept of Educational Rights in the Education Law
In the compilation of the education code,the core concept of educational rights plays a key role.The right to education is a core concept in the science of the education law;owing to the codified education law,the process of lifelong education,digital education,and extended educational rights,it is difficult for the extension of the original right to education to cover the process of citizens'lifelong education,it is difficult for its content to cover the rights granted by the Constitution and education laws,such as active learning,the organization of educational institutions or activities,scientific research,and the creation(publication)of research outcomes,and it is difficult for its conceptual scope to correspond to relevant concepts in international treaties.To reconstruct the core concept of educational rights,we should integrate citizens'educational rights,such as the right to education,the right to active learning,the right to scientific research and the creation(publication)of research outcomes,the right to organize educational institutions or activities,the right to equal education,and the right to select education,into individuals'educational rights,which should be included in the system of educational rights in the education code,together with the state's power over education,the society's right to education,and the family's right to education.In the compilation of the education code,individuals'educational rights should be used as the core concept throughout the legislation of the education code to ensure the maximum exercise of individuals'educational rights,which is the ultimate goal for the compilation of the education code.
