The Compilation of Legal Liability in China's Education Code
Legal liability is an important part to ensure the integrity of the education code.To compile the legal responsibilities in the education code,we need to follow the principles of unified value,unified standards and forward-looking legislation.Based on this route of codification,this study proposes the four-dimensional paths of compilation:simplified clauses,optimized logic,sound structure,and abundant content.We should simplify liability clauses,and avoid virtually-stipulated clauses in violation of the principle of fairness and liability clauses resulting from fragmented and duplicated liability clauses;optimize the logic of liability clauses,and flexibly use causative clauses to stipulate civil,criminal and administrative liabilities;improve the structure of legal liability,and specify relevant educational behaviors,especially emerging phenomena such as generative artificial intelligence(AI),based on the correspondence between liability clauses and obligation clauses;and enrich the content of the education code,and supplement general liability clauses to highlight the basic value of the education code and systematically link other procedural laws.
